VolloSpot Terms of Use

These Terms of Use govern the use of the VolloSpot online service available at vollospot.pl, including the creation and use of Accounts, Reservations, payments, Waiting Lists, cancellations and refunds.

Одеса, Україна, email: support@vollospot.pl, phone: +48 577 690 285, hereinafter referred to as “VolloSpot” or the “Organizer”.

Through the Service, Users may in particular browse available Games, reserve spots, join Waiting Lists, make payments, use their VolloSpot Balance and manage their Account.

These Terms are made available free of charge in a format allowing Users to save and reproduce them.

Service – the VolloSpot online platform available at vollospot.pl.

User – an individual using the Service.

Account – an individual User account within the Service.

Game – a volleyball game organized by VolloSpot at a specified place, date and time.

Reservation – a confirmed spot for a User in a specific Game.

Waiting List – a list of Users waiting for a spot to become available in a Game that is currently full.

VolloSpot Balance – an internal record of funds assigned to a User Account for settling payments for services offered by VolloSpot.

Game Price – the total price for one person to participate in a particular Game, displayed before a Reservation is made.

Making Reservations and using functions requiring User identification requires an Account.

An Account may only be created by a person who is at least 18 years old.

Users must provide accurate and up-to-date information.

Users are responsible for keeping their login credentials confidential and should not disclose them to third parties.

A User may request deletion of their Account by contacting VolloSpot.

Account deletion does not require VolloSpot to erase data that it is required or entitled to retain under applicable law.

Information about each Game is displayed in the Service.

Before making a Reservation, the User receives information including the date, time, location, Game Price, number of available spots and indicated skill level.

The indicated Game level is informational and is intended to help Users select an appropriate Game.

VolloSpot does not guarantee that the actual skill level of all participants will exactly match the level indicated in the Game description.

Each User is responsible for assessing whether a Game is suitable for their skills and abilities.

Reservations are made through the Service.

Before making a paid Reservation, the User is informed of the Game Price and the principal Reservation conditions.

Prices displayed in the Service are stated in PLN.

Electronic payments may be processed by an external payment provider, in particular WayForPay.

Payments for VolloSpot services are received by the Organizer.

If the User has a sufficient VolloSpot Balance, the Game Price may be deducted from that Balance.

A Reservation becomes effective after it has been confirmed by the system and the required payment has been made.

By making a Reservation, the User confirms that they have read and accepted the applicable Terms of Use.

A VolloSpot Balance may be maintained as part of the User Account for settling payments for services offered by VolloSpot.

The Balance may include funds paid by the User and amounts returned due to Reservation cancellations, Waiting List settlements or cancellation of a Game.

Funds recorded in the VolloSpot Balance may only be used to pay for services offered by VolloSpot.

Funds may not be transferred between User Accounts.

The VolloSpot Balance is not a bank account.

A User may request a refund of unused funds by contacting VolloSpot at support@vollospot.pl.

The refund will be made to the original payment method or by another method agreed with the User, taking into account applicable law and the technical capabilities of the payment provider.

Before issuing a refund, VolloSpot may perform reasonable verification of the User and payment to prevent fraud, errors or refunds to the wrong person.

If a Game has no available spots, the User may be offered the option to join the Waiting List.

When joining the Waiting List, the Game Price is deducted from the User’s Balance.

If a spot becomes available before the Game begins, the User in the relevant Waiting List position may be automatically moved to the participant list.

Such automatic promotion does not require additional confirmation from the User.

By joining the Waiting List, the User accepts that a spot may be automatically assigned to them.

If the User does not receive a spot in the Game, the Game Price will be automatically returned to their VolloSpot Balance.

The refund will be processed after the Game is settled and no later than 24 hours after the Game ends.

A technical delay in posting a refund does not cause the User to lose their right to the relevant funds.

A User may cancel their Reservation through the Service.

If the Reservation is cancelled at least 12 hours before the Game begins, the User will receive 100% of the Game Price back to their VolloSpot Balance.

If the Reservation is cancelled less than 12 hours before the Game begins, the Game Price is generally non-refundable.

However, if the released spot is subsequently taken by another User from the Waiting List, the User who cancelled will receive 100% of the Game Price back to their VolloSpot Balance.

If the User does not cancel and does not attend the Game (no-show), the Game Price is non-refundable.

VolloSpot may cancel a Game due to circumstances including venue unavailability, insufficient participation, organizational or technical problems, circumstances beyond the Organizer’s control or circumstances making the Game impossible or unsafe to conduct.

If VolloSpot cancels a Game, the User will receive a 100% refund of the Game Price paid.

The refund will be credited to the VolloSpot Balance.

If VolloSpot makes a material change to the time or location of a Game, the User will be informed.

If such material change prevents the User from attending, the User may cancel the Reservation and receive a full refund of the Game Price.

Nothing in this section limits mandatory rights available to the User under applicable law.

A Game Reservation concerns a sport or leisure-related service to be provided on a specified date and at a specified time.

To the extent provided by applicable consumer law, a consumer does not have the standard 14-day right of withdrawal in relation to a Reservation for a specific Game where the statutory exception for sport or leisure services provided on a specific date or during a specific period applies.

Irrespective of the above, VolloSpot provides the cancellation rights described in section 8.

Participation in volleyball involves risks normally associated with physical activity and sport.

Each User should assess whether they are able to participate safely in a Game.

Users must comply with safety rules, venue rules and reasonable instructions relating to safety and organization of the Game.

A User should not continue participating if doing so could create a danger to themselves or other participants.

Nothing in these Terms excludes or limits VolloSpot liability where such exclusion or limitation would not be permitted under applicable law.

Users must behave respectfully towards other participants, the Organizer and venue staff.

VolloSpot may temporarily restrict or suspend an Account in the event of a serious or repeated breach of these Terms.

Unless immediate action is reasonably required for safety, fraud prevention or another important reason, VolloSpot will inform the User of the reason for the restriction.

Suspension of an Account does not result in forfeiture of funds properly due to the User in their VolloSpot Balance.

A User may voluntarily connect their VolloSpot Account to their Telegram account.

Telegram may be used to send notifications regarding Reservations, Waiting Lists, spot promotions, refunds, Game cancellations or changes and reminders.

Connecting Telegram is not required to create an Account.

Important information may also be provided through the Service or using other contact information supplied by the User.

VolloSpot takes reasonable measures to maintain the proper and secure operation of the Service.

The Service may temporarily be unavailable due to maintenance, updates, failures or problems affecting external service providers.

A technical failure does not remove a User’s right to a refund or correct settlement of a Reservation where such right exists.

Complaints concerning the Service, payments, Reservations or organization of Games may be submitted by email to support@vollospot.pl.

A complaint should contain sufficient information to identify the User and the event concerned.

VolloSpot will consider complaints without undue delay and within any period required by applicable law.

VolloSpot may request additional information where reasonably necessary to investigate the complaint.

Users’ personal data is processed in accordance with applicable data protection law.

VolloSpot may amend these Terms for important reasons, including changes in law, Service functionality, payment methods, Game organization or security requirements.

Users will be informed in advance of changes where such notification is required.

Changes do not affect rights acquired by Users before the changes enter into force.

Reservations made before a new version takes effect remain subject to the conditions applicable when the Reservation was made, unless mandatory law requires otherwise.

These Terms are available in Polish, English, Ukrainian and Russian.

In the event of differences between language versions, the Polish version serves as the reference version, without prejudice to mandatory consumer rights.

The law applicable to the relationship between VolloSpot and the User is determined in accordance with applicable conflict-of-law and consumer protection rules.

Nothing in these Terms may be interpreted as depriving a consumer of protection granted by mandatory provisions of law applicable to their situation.

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected.
